What is the LEED Certification Agreement?
The LEED Certification Agreement is a legal agreement between GBCI and the property owner and is executed either directly with the owner or through the owner's authorized third-party representative, such as a consultant. The agreement defines the rights and responsibilities of the property owner and GBCI with respect to LEED certification.
Who may accept the LEED Certification Agreement?
The property owner may accept the LEED Certification Agreement, or an authorized third-party representative may accept the agreement on behalf of the owner.
How is the LEED Certification Agreement accepted?
During registration, the user will identify whether they are the property owner or an authorized third-party representative. The registration platform will then present the agreement to the user and prompt them to check a box to indicate acceptance. GBCI will log a record of such acceptance. Project team members can access a copy of the project's signed agreement within the project in Arc or LEED Online.
Additional requirements for projects registered before April 28, 2025
LEED projects registered before April 28, 2025 are subject to three additional requirements.
First, if the property owner's authorized third-party representative signed the certification agreement on behalf of the owner, then the representative (known as an "agent") and the owner must submit a Confirmation of Agent's Authority form to validate the agent's authority.
Second, if the property has multiple owners, then the entity registering the project must submit a Confirmation of Primary Owner's Authority form. That form affirms the consent of the other co-owners to the LEED registration.
Third, if the property owner changes after registration, the new owner and former owner must submit a Change of Owner Agreement. This allows the former owner's rights and obligations under the certification agreement to transfer to the new owner.
On April 28, 2025, GBCI implemented a new LEED Certification Agreement. That new agreement contains changes that, for projects registered on April 28, 2025 and later, no longer require the Confirmation of Agent's Authority, Confirmation of Primary Owner's Authority, or Change of Owner Agreement.
How do I submit a completed Confirmation of Agent's Authority form to GBCI?
Once the Confirmation of Agent's Authority form has been completed, it can be uploaded directly into LEED Online via the link on the right-hand side of the project's Details page in LEED Online.
Will GBCI sign non-disclosure agreements for teams with confidentiality concerns?
GBCI does not sign independent non-disclosure agreements, however, as explained in section 9 of the certification agreement "GBCI shall not distribute or publish any submitted plans, drawings or schematics pertaining to any project without Your express written permission except to GBCI’s employees, agents, representatives and subcontractors for the purpose of assessing the relevant Project."
